Agreement

These terms govern your use of OrphanGive, the orphan sponsorship service operated by Children's Heaven Trust, a charity registered with the NGO Affairs Bureau of Bangladesh under Registration No. iv-98/2021. By creating an account, making a donation, or otherwise using our service, you agree to these terms. If you do not agree, please do not use our service.

We have written these terms in plain language because we believe accountability is owed to those who trust us with their gifts. If anything here is unclear, write to us at hello@orphangive.org and we will explain.

Who can use OrphanGive

You must be at least eighteen years of age to create a sponsor account or make a donation. By using our service, you confirm that you are eighteen or older and that you have the legal capacity to enter into agreements in your jurisdiction.

If you are using our service on behalf of an organisation — a corporate sponsor, a foundation, a community group — you confirm that you are authorised to bind that organisation to these terms.

The nature of your sponsorship

When you sponsor a child through OrphanGive, you are making a charitable gift to Children's Heaven Trust, which is then applied to the welfare of the child or children you have chosen. You are not entering into a contract for services with the child or their guardian. You are not adopting the child. You are not establishing a legal or familial relationship with them.

Your sponsorship funds support the child's education, food, healthcare, and general welfare as administered by Children's Heaven Trust or its partner orphanages. The specific allocation of funds is determined by us in consultation with the child's caretakers based on the child's actual needs. We commit to using your contribution for its stated purpose, and we report back to you on how funds are applied.

The child you sponsor is a real person, but we maintain editorial control over what is shared about them. We may withhold or redact information for the child's safety, including identifying details, addresses, and any matter that we believe could put the child at risk.

Your donations

Donations through OrphanGive are processed by Stripe, an internationally regulated payment processor. We never see or store your full payment card details. By making a donation, you authorise the charge to your selected payment method.

Recurring sponsorships continue until you cancel them. You may cancel at any time through your account dashboard or by writing to us at hello@orphangive.org. Cancellation takes effect immediately for future payments. Past payments are not automatically refunded — see our [Refund Policy](/refund) for details.

We reserve the right to refuse or refund any donation at our discretion, including donations that we believe to be fraudulent, made in error, or made in violation of the laws of Bangladesh.

We do not issue tax-deductible receipts for donations made from outside Bangladesh, as we are not registered as a charitable entity under the tax laws of other jurisdictions. Donors in Bangladesh receive a receipt that may be used in accordance with Bangladesh tax law, subject to verification by their own tax advisor.

Your account

You are responsible for maintaining the confidentiality of your account credentials. Do not share your password. Do not allow others to use your account. If you suspect unauthorised access, notify us immediately at hello@orphangive.org and change your password.

We may suspend or terminate your account if we believe you have violated these terms, attempted to interfere with our service, or used our service for unlawful purposes. We will give notice where reasonable, but we reserve the right to act immediately in cases of suspected fraud, abuse, or risk to a child.

You may delete your account at any time. Active sponsorships will be cancelled. Historical records of completed donations will be retained in anonymised form for our auditing and accounting obligations under Bangladesh law.

What you may not do

When using OrphanGive, you agree not to:

• Use our service in any manner that violates the laws of Bangladesh or your own jurisdiction

• Attempt to gain unauthorised access to any part of our systems

• Use our service to harass, threaten, or contact a sponsored child or their guardian outside the channels we provide

• Republish, distribute, or commercially exploit child photographs, names, or stories shared with you through our service

• Misrepresent your identity, your country, or your purpose

• Use our service to launder funds or to conceal the source of contributions

Violation of these terms may result in immediate termination of your account, refund of pending sponsorships, and notification of relevant authorities where required by law.

Child welfare commitments

Our highest commitment is to the welfare of the children in our care. The children listed on OrphanGive are minors, and we take that responsibility with exceptional weight. See our [Safeguarding Policy](/safeguarding) for the details of how we protect them.

If at any point in your sponsorship you observe, suspect, or are informed of anything that suggests a child is at risk of harm, you must notify us immediately at hello@orphangive.org. We treat all such reports with absolute confidentiality and act upon them within twenty-four hours.

Intellectual property

The OrphanGive name, logo, content, and service design are the property of Children's Heaven Trust. You may not reproduce, distribute, or commercially exploit them without our written permission. Content shared with you through a sponsorship — children's photographs, school reports, handwritten letters, caretaker updates — is provided to you for your personal use only. You may not publish, share publicly, or commercialise any of this content without our explicit written consent.

Disclaimer of warranties

We provide OrphanGive in good faith and to the best of our ability. We make no warranties — express or implied — about the continuous availability of the service, the accuracy of every piece of content at all times, or the suitability of the service for any particular purpose. Software systems sometimes fail. Caretakers sometimes miss reporting deadlines. Children, like all human beings, sometimes go through periods their sponsors cannot fully anticipate. We commit to honesty about these realities.

To the maximum extent permitted by the laws of Bangladesh, we exclude liability for indirect, consequential, or special damages arising from your use of our service. Our total liability to any user in any twelve-month period shall not exceed the amount of donations that user has made to OrphanGive during that period.

Changes to these terms

We may update these terms from time to time as our service evolves or as legal requirements change. When we do, we will update the "Last updated" date at the bottom of this page. For material changes — changes that meaningfully affect your rights or obligations — we will also email all active sponsors at least thirty days before the change takes effect. Continued use of our service after a change constitutes acceptance of the revised terms.

Governing law and jurisdiction

These terms are governed by the laws of Bangladesh. Any dispute arising from your use of our service shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

Children's Heaven Trust is registered with the NGO Affairs Bureau of Bangladesh under Registration No. iv-98/2021. We operate under the regulatory framework of Bangladesh charity law.

We are not subject to the consumer protection laws of other jurisdictions unless we specifically target services to residents of those jurisdictions. We are not a 501(c)(3) organisation in the United States. We are not a registered charity in the United Kingdom or the European Union.
